Как и ожидалось, U.S. top court rebuffs mystery company in Mueller subpoena fight:

The U.S. Supreme Court on Monday refused to hear a bid by a unidentified company owned by a foreign government to contest a grand jury subpoena related to Special Counsel Robert Mueller’s now-completed inquiry into Russia’s role in the 2016 election, though the justices’ action does not force the firm to comply.

A federal judge has imposed an ongoing fine of $50,000 a day against the company, which had asked the justices to hear its appeal of a December lower court ruling that upheld a judge’s decision to hold it in contempt for refusing to fulfill the document request made in the subpoena.

The Supreme Court rejected the appeal in a brief order with no noted dissents from any of the nine justices.

But now what?

В своем письме Барр приводит эту цитату из доклада: "The investigation did not establish that members of the Trump Campaign conspired or coordinated with the Russian government in its election interference activities."

And that's OK. Если следствие не установило, значит не установило, как я уже говорил, это абсолютно легитимный результат расследования.

Что значит "did not establish":

When prosecutors say that an investigation “did not establish” something, that doesn’t mean that they concluded it didn’t happen, or even that they don’t believe it happened. It means that the investigation didn’t produce enough information to prove that it happened.

Это пишет бывший федеральный прокурор, но это очевидная же вещь. И чтобы это понимать, не нужно быть прокурором, для этого и юридического образования не требуется.

Куда менее очевидно, но не менее важно другое. К чему относится "conspired or coordinated with the Russian government in its election interference activities"?

Во-первых, что значит "with the Russian government"? Is Kilimnik Russian government? Is WikiLeaks?

Во-вторых, о каких "election interference activities" идет речь? В следующем параграфе Барр говорит, что "The Special Counsel's investigation determined that there were two main Russian efforts to influence the 2016 election." Эти efforts -- тролли в соцсетях (Internet Research Agency) и кража e-mail'ов. Барр отмечает, что "the Special Counsel did not find that the Trump campaign, or anyone associated with it, conspired or coordinated with the Russian government in these efforts, despite multiple offers from Russian-affiliated individuals to assist the Trump campaign."

То есть Барр говорит, что Мюллер не установил, что люди, связанные с кампанией Трампа, участвовали в краже e-mail'ов и организации троллей в соцсетях? Ну, OK, но это далеко не все из того, что в просторечии называли collusion.

Скажем, вопрос, который занимает всех с 2016 года: как Роджер Стоун, человек связанный с кампанией Трампа, узнал о грядущей публикации e-mail'ов Подесты? И если он узнал об этом от WikiLeaks, является ли это collusion, которую Мюллер не смог установить?

И вот что еще. Я не видел, чтобы кто-то отметил "despite multiple offers from Russian-affiliated individuals to assist the Trump campaign".

Это Барр говорит в контексте кражи e-mail'ов. Кто-то предлагал кампании Трампа поучаствовать в краже что ли? Я никаких сообщений об этом не видел. И если речь не об e-mnail'ах, а вообще, то единственное известное предложение, о котором сообщалось, -- это, по-моему, предложение Весельницкой. Или было что-то еще, о чем я забыл?

Подытожим. На данный момент, мы имеем только тот факт, что Мюллер не нашел оснований для предъявления обвинений американцам в criminal conspiracy. И это, безусловно, очень важный факт. Но не нужно серьезно относится к "exonеrated", "cleared", "vindicated" и тому подобному буллшиту. Понятно, почему эти слова повторяют Трамп и трамисты, но остальным в этом участвовать ни к чему.

Кампания Трампа призывает телепродюсеров не приглашать гостей, которые делают "outlandish", "outrageous" и, о ужас, "unsupported" (!) claims.

Кампания Трампа! Think about it. Нет, серьезно, think about it.
