F.B.I. Raids Office of Trump’s Longtime Lawyer Michael Cohen

The F.B.I. on Monday raided the office of President Trump’s longtime personal lawyer, Michael D. Cohen, seizing records related to several topics including payments to a pornographic-film actress.

Federal prosecutors in Manhattan obtained the search warrant after receiving a referral from the special counsel, Robert S. Mueller III, according to Mr. Cohen’s lawyer, who called the search “completely inappropriate and unnecessary.” The search does not appear to be directly related to Mr. Mueller’s investigation, but likely resulted from information he had uncovered and gave to prosecutors in New York.

“Today the U.S. Attorney’s Office for the Southern District of New York executed a series of search warrants and seized the privileged communications between my client, Michael Cohen, and his clients,” said Stephen Ryan, his lawyer. “I have been advised by federal prosecutors that the New York action is, in part, a referral by the Office of Special Counsel, Robert Mueller.”

The payments to Ms. Clifford are only one of many topics being investigated, according to a person briefed on the search. The F.B.I. also seized emails, tax documents and business records, the person said.

The seized records include communications between Mr. Trump and Mr. Cohen, which would likely require a special team of agents to review because conversations between lawyers and clients are protected from scrutiny in most instances.

Law enforcement agents spent several hours at the Loews Regency hotel on Monday morning as they executed a search warrant against the president’s personal lawyer. Cohen’s attorney said they were referred by Robert Mueller.

Вообще говоря, упоминание Мюллера очень странно в данном контексте: к влиянию России на выборы это имеет даже меньше отношение, нежели старые махинации Манафорта по урыванию доходов. Там, хотя бы, пусть и криво можно было увязать доходы с Россией, но тут - просто выход за рамки.

В том случае, если подсудимый считает, что прокурор превысил полномочия или раздобыл доказательства преступления с нарушением закона, у него есть возможность обжаловать эти действия в судебном порядке. Пол Манафорт сейчас этим занимается, но пока что не особенно успешно.

Олег Дерипаска, покровитель Манафорта, тоже попал в пятницу под санкции.

Как вам уже сказал дзига, Мюллер не проводил эти обыски, это не его расследование, вообще. Он узнал что-то (мы не знаем что) в процессе своего расследования, и передал эту информацию нью-йоркскому прокурору. А дальше тот уже решил, что обыски будут уместны.

Как говорят сейчас все, для того, чтобы получить ордер на обыск адвоката, нужно jump through уйму hoops. Чтобы запрос на ордер на обыск адвоката был одобрен, он должен быть подкреплен очень серьезной информацией о вероятном преступлении.

Обычно документы запрашивают ордером без нужды на обыск. Для того, чтобы получить ордер на срочный обыск, нужны серьезные свидетельства того, что подозреваемый пытается спрятать или уничтожить вещественные доказательства.

Неясно, причём здесь пожар в Trump Tower.

Вообще-то о том что Коэна вот-вот возьмут за задницу заговорили сразу после того как Трамп слил Коэна сказав что он не знал что Коэн заплатил Даниелс. Это сразу вынуло из компота "attorney-client privelege". Почему он это сказал? Мог просто ляпнуть как "знал что Флинн врал ФБР", но может быть там что -то такое происходит что ему было выгодней Коэна слить?
Будем ждать следующую серию этого сериала.

И всё равно мне не нравится идея обыска у адвоката. Наверняка часть нарытых документов относятся к делам, покрывающимся привилегией. Он, конечно, адвокат мафии, но всё же адвокат.

Вполне может быть. В этом случае следователи ФБР обязаны такую информацию проигнорировать и ею никак не пользоваться. Если они этого не сделают и таки нарушат закон и воспользуются этой информацией, то уже в суде адвокаты Коэна им покажут кузькину мать. Такое событие это реальный повод для закрытия дела, если даже выяснится что Коэн воровал и ел младенцев.
Но мне кажется что более релевантным к этой истории является то , что если адвокат и клиент вступают в сговор с целью нарушить закон, то "attorney-client privilege" перестаёт действовать. А зная то что мы сейчас знаем про fixer Коэна...

Там даже, если верить Lawfare, гораздо более мягкий критерий - достаточно того, что услуги адвоката использовались с целью совершить преступление. Адвокату сознательно вступать в сговор необязательно.
