F.B.I. Raids Office of Trump’s Longtime Lawyer Michael Cohen

The F.B.I. on Monday raided the office of President Trump’s longtime personal lawyer, Michael D. Cohen, seizing records related to several topics including payments to a pornographic-film actress.Update: SEARCHED AND SEIZED: F.B.I. RAIDS MICHAEL COHEN’S NEW YORK HOTEL
Federal prosecutors in Manhattan obtained the search warrant after receiving a referral from the special counsel, Robert S. Mueller III, according to Mr. Cohen’s lawyer, who called the search “completely inappropriate and unnecessary.” The search does not appear to be directly related to Mr. Mueller’s investigation, but likely resulted from information he had uncovered and gave to prosecutors in New York.
“Today the U.S. Attorney’s Office for the Southern District of New York executed a series of search warrants and seized the privileged communications between my client, Michael Cohen, and his clients,” said Stephen Ryan, his lawyer. “I have been advised by federal prosecutors that the New York action is, in part, a referral by the Office of Special Counsel, Robert Mueller.”

The payments to Ms. Clifford are only one of many topics being investigated, according to a person briefed on the search. The F.B.I. also seized emails, tax documents and business records, the person said.
The seized records include communications between Mr. Trump and Mr. Cohen, which would likely require a special team of agents to review because conversations between lawyers and clients are protected from scrutiny in most instances.
Law enforcement agents spent several hours at the Loews Regency hotel on Monday morning as they executed a search warrant against the president’s personal lawyer. Cohen’s attorney said they were referred by Robert Mueller.

Date: 2018-04-09 11:21 pm (UTC)The comments by U.S. District Judge Amy Berman Jackson came Wednesday at the first hearing in a civil case that Manafort filed in January to claim Mueller, who is investigating Russian meddling in the 2016 election, overstepped his authority. Manafort was accused of money laundering and failing to report his lobbying in Ukraine.
Jackson told Manafort’s lawyer that his client’s case hinges on showing violations of federal regulations overseeing Mueller’s appointment, even though the law explicitly bars giving individuals the right to sue.
“What am I supposed to do about that? Ignore it?” the judge asked.
“Yes, of course,” said Manafort attorney Kevin Downing in federal court in Washington, as his client looked on.
Downing is suing under the Administrative Procedure Act, but the judge suggested he may not succeed.э
“Do you have a single legal case that suggests that being subject to criminal investigation is actionable under the APA?” Jackson asked Downing.
Downing said that he couldn’t cite any cases and that his was the first challenge of its type.

Date: 2018-04-10 11:04 pm (UTC)"According to John Moye, an Atlanta-based litigator at Kilpatrick Townsend, the bar for invoking the crime fraud exception to the attorney-client privilege is a high one.
"The fact that the judge issued a search warrant of the office and home of Trump's personal attorney suggests that a judge likely concluded either that the privilege was being used in furtherance of a criminal act or that the privilege was being used to perpetuate a fraud," Moye explained. "
Почему-то не я один зациклился на "судье". :-)
